Aquest Reial decret ha estat en vigor fins al dia 28 d\u2019abril de 2026, quan ha estat tombat al Congr\u00e9s dels Diputats pels vots negatius de la dreta i l\u2019extrema dreta.<span style=\"font-weight: 400;\"><\/span><\/span><\/p>\n<p><strong>Si has demanat la pr\u00f2rroga entre el 22 de mar\u00e7 i el 28 d\u2019abril de 2026, ambd\u00f3s dies inclosos, la pr\u00f2rroga \u00e9s v\u00e0lida i la farem valer. <\/strong>\u00c9s possible que el teu propietari t\u2019hagi respost denegant la pr\u00f2rroga (argumentant necessitar l\u2019habitatge per a \u00fas propi, aprofitant la caiguda del Reial decret, etc.). Per tot aix\u00f2, hem preparat diferents models de resposta. <\/p>\n<p><strong>\u00c9s molt important que, a difer\u00e8ncia del cas dels models de pr\u00f2rrogues, no facis servir aquests models sola. Les contestacions legals s\u2019han d\u2019adaptar b\u00e9 als arguments que realment hagin utilitzat els propietaris. \u00c9s imprescindible assistir a una reuni\u00f3 del sindicat o contrastar-los amb un advocat propi. A m\u00e9s, hem de ser conscients que la pr\u00f2rroga nom\u00e9s ens dona dos anys. 28px;\">Qu\u00e8 pot passar ara que el Reial decret no est\u00e0 en vigor?<\/span><\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">El RD-llei 8\/2026 va estar en vigor entre el 22 de mar\u00e7 de 2026 i el 28 d\u2019abril del mateix any. <b>El dret a la pr\u00f2rroga i a la limitaci\u00f3 de les pujades al 2% \u00e9s v\u00e0lid si s\u2019ha realitzat la comunicaci\u00f3 al propietari en aquest mateix per\u00edode <\/b>(en el cas de la pujada del 2%, l\u2019actualitzaci\u00f3 de la renda ha d\u2019haver coincidit amb el per\u00edode en qu\u00e8 ha estat en vigor el Reial Decret). Per\u00f2 \u00e9s possible que amb la caiguda del Reial decret els rendistes aprofitin per respondre els nostres escrits amb contestacions denegant la pr\u00f2rroga. \u00c9s una estrat\u00e8gia habitual: causar confusi\u00f3. Per\u00f2 recorda, no importa el que digui el propietari: la pr\u00f2rroga \u00e9s v\u00e0lida. Tot i aix\u00ed, no ens quedarem callades. Farem valer els nostres drets. I el primer pas per fer-ho \u00e9s contestar-los amb contund\u00e8ncia.      <b>I el primer pas per fer-ho \u00e9s contestar-los amb contund\u00e8ncia.<\/b><\/span><\/p>\n<h2><strong>Per qu\u00e8 contestar al propietari si la pr\u00f2rroga \u00e9s v\u00e0lida nom\u00e9s demanant-la?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">L\u2019estrat\u00e8gia habitual del rendisme \u00e9s que visquem amb por. Ells tenen m\u00e9s mitjans (advocats, immobili\u00e0ries, patronals, etc.) que nosaltres. Per\u00f2 nosaltres som m\u00e9s. Enviar pr\u00f2rrogues massivament i contestar els seus arguments \u00e9s una acci\u00f3 col\u00b7lectiva de rebuig al fet que especulin amb les nostres vides.    <\/span><strong>Els drets s\u2019han de fer valer i el primer pas per fer-ho \u00e9s contestar-los amb contund\u00e8ncia.<\/strong> <span style=\"font-weight: 400;\">Els propietaris han de veure que estem organitzades, som moltes i tenim bons arguments, tamb\u00e9 legals.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Tot i que amb la mera comunicaci\u00f3 n\u2019hi ha prou per fer valer la pr\u00f2rroga, val la pena refor\u00e7ar la nostra posici\u00f3 i donar per acceptada la pr\u00f2rroga responent al propietari. <\/strong>A m\u00e9s, en alguns casos \u00e9s possible que pretenguin amena\u00e7ar amb demandes. \u00c9s molt probable que algunes pr\u00f2rrogues acabin passant pels tribunals. I en tal cas, els nostres arguments legals a l\u2019empara del Reial decret han d\u2019estar presents de forma massiva.  <\/span><\/p>\n<p>Finalment: <b>mereixem dormir tranquil\u00b7les<\/b>. Aquestes comunicacions serveixen perqu\u00e8 no ens quedem amb la sensaci\u00f3 d\u2019incertesa per la resposta del propietari.<\/p>\n<h2><strong>Qu\u00e8 respondre al propietari?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Durant un mes hem ajudat milers de llogateres a demanar la seva pr\u00f2rroga. A m\u00e9s, hem recopilat les respostes dels propietaris. Aix\u00ed que hem preparat una s\u00e8rie de models de contestaci\u00f3 en el cas que ens escriguin rebutjant la pr\u00f2rroga. Els models es diferencien entre ells segons l\u2019argument del propietari per denegar la pr\u00f2rroga. Per a aquesta contestaci\u00f3 tenim m\u00e9s temps, tot i que cal fer-la abans de la data de venciment del contracte o pr\u00f2rroga contractual. \u00c9s molt important utilitzar el model correcte, aix\u00ed que      <\/span><b>llegeix aquesta informaci\u00f3 i l\u2019escrit del propietari amb atenci\u00f3 i acudeix a l\u2019assemblea del teu sindicat m\u00e9s proper per resoldre els dubtes (no envieu el model soles). <\/b><\/p>\n<p><span style=\"font-weight: 400;\">Els models preparats, segons arguments dels rendistes, s\u00f3n:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Model 1: Denegar la pr\u00f2rroga amb l\u2019excusa que el Congr\u00e9s dels Diputats ha votat en contra del Reial Decret.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Model 2: Denegar la pr\u00f2rroga amb la mentida de necessitat de l\u2019habitatge per a \u00fas propi o d\u2019un familiar.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Model 3: Denegar la pr\u00f2rroga en zones declarades com a \u00e0rea tensa.<br \/>(consulta si tu municipi es \u00e0rea tensa en el seg\u00fcent <a href=\"https:\/\/www.mivau.gob.es\/vivienda\/alquila-bien-es-tu-derecho\/serpavi\/consultar-zonas-de-mercado-residencial-tensionado\" style=\"font-size: 16px;\">enlla\u00e7<\/a>)<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">En el cas que el propietari no hagi respost, no \u00e9s necessari enviar cap model.<\/span><\/p>\n<h2>Com utilitzar els models?<\/h2>\n<p>Desc\u00e0rrega el model, modifica&#8217;l amb les teves dades i elimina els colors i anotacions entre par\u00e8ntesis.<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Llegeix amb atenci\u00f3 l\u2019escrit del propietari i busca l\u2019argument pel qual se\u2019t denega la pr\u00f2rroga.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Rellena el formulario de est\u00e1 p\u00e1gina.<span style=\"font-weight: 400;\"><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Descarga el modelo correspondiente (seg\u00fan argumento) del correo electr\u00f3nico que recibir\u00e1s, modif\u00edcalo con tus datos y elimina los colores y anotaciones entre par\u00e9ntesis.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><b>IMPORTANTE:<\/b> Asistir a una assemblea del sindicat abans d\u2019enviar el model per adaptar-lo.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b style=\"font-size: 16px;\">IMPORTANT: <\/b>Envia sempre el model de contestaci\u00f3 abans de la data d\u2019extinci\u00f3 del contracte.<\/li>\n<\/ul>\n<h3>Recomanacions importants:<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Envia els models per un mitj\u00e0 que deixi const\u00e0ncia (burofax, correu electr\u00f2nic certificat, etc.).<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Guarda c\u00f2pia de tot el que envi\u00efs i rebis.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">No negoci\u00efs individualment si hi ha conflicte: els propietaris intentaran pressionar o desinformar.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">En la mesura que sigui possible, abans d&#8217;enviar-ho, <a href=\"https:\/\/poderinquilino.org\/ca\/afiliat\/\">afilia&#8217;t <\/a>i acosta&#8217;t al teu sindicat de llogateres m\u00e9s pr\u00f2xim per a revisar-lo i fer-ho amb suport col\u00b7lectiu.<\/li>\n<\/ul>\n<p>Aquestes eines s\u00f3n molt m\u00e9s eficaces si s&#8217;usen col\u00b7lectivament. Ja sigui aplicant l&#8217;RD o l&#8217;estrat\u00e8gia #EnsQuedem, \u00e9s m\u00e9s f\u00e0cil no cedir davant pujades abusives ni expulsions si estem sostingudes pel nostre Sindicat i pressionant des de l&#8217;organitzaci\u00f3 col\u00b7lectiva.<br \/>  <a href=\"https:\/\/poderinquilino.org\/ca\/afiliat\/\">Uneix-te a nosaltres!<\/a><\/p>\n<h2><strong>El Reial decret llei 8\/2026 no \u00e9s una soluci\u00f3 al problema del lloguer, per\u00f2 s\u00ed una vict\u00f2ria fruit de la lluita llogatera<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Mentre els propietaris continuen pujant preus i expulsant-nos dels nostres barris, el Govern respon amb mesures limitades i temporals que no frenen el negoci de l\u2019habitatge. El Reial decret era una mesura insuficient, per\u00f2 que nom\u00e9s va ser possible gr\u00e0cies a la lluita dels Sindicats de Llogateres. Tot i aix\u00ed, ara els partits del lobby rendista han decidit tombar la mesura al Congr\u00e9s dels Diputats. Aix\u00ed que prepara\u2019t perqu\u00e8 aviat ens tocar\u00e0 tornar a prendre els carrers. El fonamental, com sempre, \u00e9s organitzar-nos col\u00b7lectivament.    <\/span> <strong>Quan ens organitzem, tenim m\u00e9s poder que qualsevol propietari o pol\u00edtic.<\/strong><\/p>\n<p>No hem d&#8217;oblidar que les eines legals nom\u00e9s funcionen quan se sostenen amb suport mutu i pressi\u00f3. Fins i tot sense eines legals, som capaces de quedar-nos a casa i lluitar contra els abusos dels propietaris. Ho sabem perqu\u00e8 els sindicats de llogateres fa 9 anys que fem servir <a href=\"https:\/\/inquilinato.org\/defiendete\/sumante-a-nos-quedamos\/\">l&#8217;estrat\u00e8gia #EnsQuedem<\/a>, desobeir els propietaris, negociar des de la for\u00e7a col\u00b7lectiva i defensar que ning\u00fa marxi de casa seva perqu\u00e8 no li renovin el contracte o no pugui pagar. Ho hem aconseguit milers de vegades. Si se t&#8217;acaba el contracte, no est\u00e0s sola.
